Terms & Conditions
This Agreement contains the entire understanding between PORTRAITS BY DREW and the CLIENT. It supersedes all prior and simultaneous agreements.
BOOKING FEE: Both CLIENT and PHOTOGRAPHER agree that the full session fee is to be paid before any photos are delivered to CLIENT.
METHODS OF PAYMENT: I accept payments from the following: facebook messenger, cash app, paypal, Apple Pay, this website, cash, or check. >>Please note. any returned payments will. be subject to a $35 inconvenience fee.<<
COPYRIGHTS AND SOCIAL MEDIA (MUST READ!!!):
>>>>The photography produced by PORTRAITS BY DREW are protected by Federal Copyright Laws (all rights reserved) and MAY NOT be reproduced in any manner without PORTRAITS BY DREW explicit written permission. If displayed on social networking sites or other web outlets, photos MUST contain PORTRAITS BY DREW logo AND/OR Photo Credit to PORTRAITS BY DREW in the description as well as a link to PORTRAITS BY DREW current Facebook Page. To link the Facebook page you simply type the following, @PORTRAITS BY DREW and as long as you like the page, it will be tagged. <<<<
CLIENT must agree to the copyright terms as listed below:
1. The CLIENT must obtain written permission from and compensate PORTRAITS BY DREW prior to the CLIENT or the CLIENT'S friends/relatives/other publishing the photograph to any persons, business, or marketing.
2. CLIENTS MAY NOT edit any photos taken byPORTRAITS BY DREW. This is including but not limited to Instagram/Facebook Filters, Quick Edit Apps, Photoshop, etc.
EXHIBITION: CLIENT grants PORTRAITS BY DREW permission to display selected images resulting from this session as an example of PORTRAITS BY DREW'S work while releasing all claims to profits that may arise form the use of images as well as any print or online publication.
MINOR AND NON-MINOR MODEL RELEASE: For valuable consideration received, I the CLIENT, hereby grant to PORTRAITS BY DREW, (Photographer) and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, or editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction and to copyright the same. I hereby release Photographer and her legal representatives and assigns from all claims and liability relating to said photos .
RAW IMAGES: Under no circumstances will PORTRAITS BY DREW give the CLIENT any raw or unedited images. Requests for such images will be denied.
CELLULAR DEVICES / CAMERAS / CAMCORDERS: While your session is taking place you may not use your cell phone, personal camera, or camcorder to take pictures and or record for any reason. The photographer can and will stop and terminate the session should you breach this agreement.
TURN AROUND TIME: PORTRAITS BY DREW will have images fully edited and delivered within 30 days of your session date unless stated otherwise. Weddings range from 1-12 weeks depending on how large your wedding was. Drew Hand edits every single photo to ensure you're receiving Photographs that will last a lifetime and are pieces of art.
DELIVERY OF IMAGES: CLIENT will receive an email with a link to the online gallery. From there the CLIENT will be able to select the photos they would like to obtain.
Once the client has "favorited" the images they purchased, Drew will go back in and smooth any skin, stray hairs, sharpen eyes and more. IF CLIENT wants to purchase additional photos they are ($15/photo). You also have the options to purchase Pro Grade Prints, Books, Canvases and more.
A sneak peek MAY be posted online in any format prior to photos being delivered to CLIENT. CLIENT agrees to this being completely acceptable. Not all photos will be posted online, it's up to Photographers discretion for her page/website what she chooses to post.
Your gallery will be posted online for 45 days. Once your album has been taken down, a fee of $50 will be required to republish your photos. There is NO GUARANTEE that your photos will be able to be republished after the 45 days is up. PLEASE BACKUP IMMEDIATELY AFTER RECEIVING YOUR IMAGES! To back yo you will need to download HIGH RES from your gallery onto your computer. Images being shared on Social Media will need to be the Web Size Downloads. If you don't have access to a computer, Contact Drew and she can provide a CD, Jump Drive and more products. TABLETS AND PHONES WILL NOT WORK!
CANCELLATION POLICY: All Session fees are --NON-- refundable--
PORTRAITS BY DREW reserves the right to reschedule the session as necessary due to weather or any sickness. If CLIENT must cancel, sessions may be rescheduled ONLY under special circumstances discussed between CLIENT and PHOTOGRAPHER. NO SHOWS OR CANCELLATIONS WITHOUT A 48 HR NOTICE WILL LOSE ALL DEPOSITS!
LATE POLICY: In the event that the CLIENT is late to their session, no extra time will be given. PORTRAITS BY DREW will not be liable for images not taken due to the CLIENT tardiness. Every minute that the CLIENT is late is a minute they will lose in their shoot time.
PERSONAL APPEARANCE / UNCOOPERATIVE SUBJECTS: Re-shoots and refunds WILL NOT be given for poor choices of clothing, make-up, hair, or the lack of cooperation of subjects or not following the recommendations of the Photographer. Your cooperation is required before and during any session held with PORTRAITS BY DREW
SPECIFIC IMAGES: PORTRAITS BY DREW and the CLIENT agree that the photographer is under no obligation to capture any specific moment or pose during the session.
IMAGES: While the Photographer does capture many images during the session, the CLIENT understands that he/she will see only those images selected by the photographer. Each image is rendered carefully to ensure maximum artistry and technical perfection. Images with eyes closed, heads turned, duplicates, etc. will not be shown and are removed from the archives permanently after the artist rendering is complete. Awakening Photography is responsible for all images chosen and can delete AND EDIT any at their discretion. ANY REQUESTS OF RE - EDITING WILL RESULT IN CHARGES.
LIABILITY: CLIENT agrees to hold harmless PORTRAITS BY DREW from any dispute in the event that you or any member of your family become injured during the session. PORTRAITS BY DREW will not be held liable for any injury to you, your children, animals, or family/friends or to any damage to your property during the session or while on location. CLIENTS ALSO AGREE TO KEEP THEIR CHILDREN UNDER CONTROL. ANY DAMAGES TO PROPS, LOCATION, PHOTOGRAPHER OR EQUIPMENT, CLIENT. CLAIMS RESPONSIBILITY TO REPLACE OR FIX.
TERMINATION: PORTRAITS BY DREW reserves the right to terminate the relationship between themselves and the client should the Photographer feel threatened, or harassed in any way. Termination will not result in any refunds of any kind. EX: aggressiveness, screaming/cursing at photographer, physical contact, etc.
REVIEWS: CLIENT agrees that before any poor reviews are written, spoken, or published, the CLIENT must first speak to the PHOTOGRAPHER to work out any issues. Any false information published about Awakening Photography is considered slander.

Timing Agreement
These sessions are back to back with no time between for clients to be tardy.
Understand that you only have 15 minutes- if you are late for any reason whatsoever that takes away from your session time. We recommend leaving your home early to account for any unforeseen events (traffic, flat tire) that may come up to cause you to be late.
If you have multiple families that you want to include I'd suggest booking 2 sessions back to back. Photos Take anywhere from 1-3 weeks to get back. Please Be aware of this. If you need them SOONER, I can add a rush order fee of $65.
